4. Counter-Notification Procedure

If you believe that your content was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a counter-notification to our copyright agent. Your counter-notification must include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or the district where you are located, if outside the United States) and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. That party will then have a specified period to file a lawsuit. If no lawsuit is filed, we will restore the removed content or re-enable access to it.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, ToolsOx has adopted a policy of terminating access for users or account holders who are found to be repeat infringers of copyright. We maintain a record of all DMCA notices received and take appropriate action against users who are the subject of multiple valid infringement claims.

We also reserve the right to remove any content that we believe, in our sole discretion, infringes upon the copyrights of others, even in the absence of a formal DMCA notice. This proactive approach helps us maintain the integrity of our platform and protect the rights of content creators.

6. False Claims and Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. This means that if you submit a DMCA takedown notice that contains false claims of infringement, you may be held legally responsible for any harm caused to the alleged infringer, ToolsOx, or any other affected party.

Similarly, submitting a false counter-notification may also result in legal consequences. We encourage all parties to act in good faith and seek legal counsel before filing any DMCA-related notices or counter-notifications.
